title: EEO-5 Elementary-Secondary Staff Data
description: 'EEO-5 Public Use File (PUF): aggregated staffing counts that EEOC publishes from the biennial EEO-5 Elementary-Secondary Staff Information report (EEOC Form 168A), filed by every public elementary and secondary school system or district with 100 or more employees in the 50 U.S. states and the District of Columbia. Filing is mandatory under Section 709(c) of Title VII of the Civil Rights Act of 1964 (42 U.S.C. 2000e-8(c); 29 CFR 1602.39 and .41-.45; OMB No. 3046-0003). EEOC uses the data to enforce civil rights laws in public education and shares it with the U.S. Department of Education Office for Civil Rights (OCR) and the U.S. Department of Justice; the assignment detail (elementary versus secondary teachers, guidance, psychological, librarians, and instructional consultants) lets analysts examine equity within the teaching and instructional ranks, not just overall school staffing. Districts report full-time staff, part-time staff, and new hires across standardized assignment categories by race/ethnicity and sex. EEO-5 is collected biennially in even-numbered years and covers the payroll period closest to October 1 (no later than November 30) of the reporting year. Each row is an aggregate cell keyed by state, year, assignment category, employment classification, race/ethnicity, and sex; small or identifying cells pass through Section 709(e) confidentiality suppression.'
